2.5. We do not ask for sensitive information (such as information about your health, racial or ethnic origin, political opinions, religious beliefs or criminal record). If sensitive information is needed for a particular engagement, we will only collect it with your consent and where it is reasonably necessary.
2.6. You may deal with us anonymously or using a pseudonym where that is lawful and practicable, for example when making a general enquiry. In most cases, however, we need your name and contact details to respond to you or to provide our services.
2.7. If we receive personal information that we did not ask for and could not have collected under this policy, we will destroy or de-identify it as soon as practicable, where it is lawful and reasonable to do so.
3. How we collect your personal information
3.1. Advisory & Consultancy collects personal information from you in a variety of ways, including when you interact with us electronically or in person, when you access our website and when we provide our services to you. We may receive personal information from third parties. If we do, we will protect it as set out in this Privacy Policy.
3.2. Where it is reasonable to do so, we will let you know at or before the time we collect personal information (for example, on our website forms) who we are, why we are collecting it and how you can contact us, as described in this policy.

4.3. In particular, we use personal information to respond to your enquiries, arrange appointments, provide and manage our services, prepare proposals and engagement documents, issue invoices, keep business records, meet our legal and regulatory obligations, and maintain and improve our website. We will only use or disclose your personal information for another purpose if you consent, if you would reasonably expect it and it is related to the purpose of collection, or if the law permits or requires it.
4.4. Direct marketing. We may send you information about our services, events or insights where you have asked for it or would reasonably expect to receive it, or where you have otherwise consented. Every marketing email or SMS we send includes a way to unsubscribe, and you can ask us at any time to stop sending you marketing material using the details in clause 12. We do not sell or rent your personal information to anyone.
5. Disclosure of your personal information
5.1. We may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes set out in this Policy. Personal information is only supplied to a third party when it is required for the delivery of our services.
5.2. We may from time to time need to disclose personal information to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request.
5.3. We may also use your personal information to protect the copyright, trademarks, legal rights, property or safety of Advisory & Consultancy, its customers or third parties.

5.5. If there is a change of control in our business or a sale or transfer of business assets, we reserve the right to transfer to the extent permissible at law our user databases, together with any personal information and non-personal information contained in those databases. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. We would seek to only disclose information in good faith and where required by any of the above circumstances.
5.6. Where we disclose your personal information to third parties, we will request that the third party follow this Policy regarding handling your personal information.
5.7. Overseas disclosure. Some of the service providers we use to run our business store or process information outside Australia. In particular, our website is hosted by Squarespace, and we use cloud-based email, document storage, analytics and productivity services. As a result, personal information may be stored in or accessed from the United States of America and other countries where those providers or their sub-processors operate. Before we disclose personal information overseas, we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles, including by using reputable providers that are bound by privacy and security terms.
5.8. The kinds of third parties we may disclose personal information to include our website host and form provider, providers of email, cloud storage, accounting, scheduling and analytics services, our professional advisers, and any other party you ask us to share information with.

6.2. The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us, or receive from us. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.
6.3. We keep personal information only for as long as it is needed for the purposes described in this policy, including to meet our legal, tax, accounting and insurance obligations. When it is no longer needed, we take reasonable steps to securely destroy it or de-identify it.
6.4. Data breaches. If we become aware of a data breach involving personal information we hold, we will act promptly to contain it and assess the risk of harm. Where a breach is likely to result in serious harm and the Privacy Act requires it, we will notify the individuals affected and the Office of the Australian Information Commissioner (OAIC).
7. Access to your personal information
7.1. You may request details of personal information that we hold about you in accordance with the provisions of the Privacy Act 1988 (Cth). A small administrative fee may be payable for the provision of information. If you would like a copy of the information, which we hold about you or believe that any information we hold on you is inaccurate, out of date, incomplete, irrelevant or misleading, please email us at info@advisoryandconsultancy.com.
7.2. We reserve the right to refuse to provide you with information that we hold about you, in certain circumstances set out in the Privacy Act.
7.3. If you ask us to correct personal information that is inaccurate, out of date, incomplete, irrelevant or misleading, we will take reasonable steps to correct it. We aim to respond to requests for access or correction within a reasonable period, usually 30 days. If we refuse a request, we will tell you why in writing and how you can complain. We do not charge for making a request or for correcting information.

10. Website
10.1. When you visit our website
When you come to our website (www.advisoryandconsultancy.com) we may collect certain information such as browser type, operating system, website visited immediately before coming to our site, etc. This information is used in an aggregated manner to analyse how people use our site, such that we can improve our service.
10.2. Cookies
We may from time to time use cookies on our website. Cookies are very small files which a website uses to identify you when you come back to the site and to store details about your use of the site. Cookies are not malicious programs that access or damage your computer. Most web browsers automatically accept cookies but you can choose to reject cookies by changing your browser settings. However, this may prevent you from taking full advantage of our website. Our website may from time to time use cookies to analyse website traffic and help us provide a better website visitor experience. In addition, cookies may be used to serve relevant ads to website visitors through third party services such as Google Ads. These ads may appear on this website or other websites you visit.
10.3. Third party sites
Our site may from time to time have links to other websites not owned or controlled by us. These links are meant for your convenience only. Links to third party websites do not constitute sponsorship or endorsement or approval of these websites. Please be aware that Advisory & Consultancy is not responsible for the privacy practices of other such websites. We encourage our users to be aware, when they leave our website, to read the privacy statements of each and every website that collects personal identifiable information.
10.4. Website hosting, forms and analytics
Our website is hosted on the Squarespace platform. Squarespace processes the information you submit through our website forms and the technical information described in clause 10.1 on our behalf, uses its own cookies to operate and secure the website, and provides us with aggregated visitor statistics. Squarespace may store this information in the United States of America and other countries, and its own privacy policy explains how it handles personal information. Our website forms are protected by Google reCAPTCHA, which sends information about your device and your use of the form to Google; Google's Privacy Policy and Terms of Service apply.
11. Artificial intelligence (AI) and automated decisions
11.1. We use artificial intelligence (AI) tools, including features built into the software and website services we use, to help draft, edit, summarise, translate and check documents and correspondence and to organise notes and research. Our advisers review AI-assisted work and remain responsible for the advice we give.
11.2. These tools may process personal information described in clause 2, such as the details in an enquiry or information about you and your business that is relevant to an engagement, only for the purposes in clause 4. Information an AI tool produces about you, such as a summary or a note, is handled under this policy like any other personal information.
11.3. We do not enter sensitive information into publicly available AI tools, we use only the personal information a task needs, and where we use AI services with client information we choose business versions whose terms do not allow the provider to use our content to train their models. AI providers may store or process information outside Australia (see clause 5.7).
11.4. Automated decisions. We do not use computer programs, including AI, to make decisions that could reasonably be expected to significantly affect your rights or interests, or to do anything substantially and directly related to making such decisions, using your personal information. If that changes, we will first update this policy to set out the kinds of personal information used and the kinds of decisions involved.
11.5. You can ask us whether AI tools have been used with your personal information, or ask that they are not used in your engagement, using the details in clause 12.
